Terms of Service & Community Guidelines

This page contains two documents. Part One is our Terms of Service, the agreement that governs your use of DISH. Part Two is our Community Guidelines, which set out what belongs on DISH and how we expect people to behave. The Guidelines form part of the Terms, so breaking them breaks the Terms.
Our Privacy Policy is a separate document and explains what information we collect and why.
Part One — Terms of Service
These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and DISH INTELLIGENCE INC., a corporation with its principal place of business at 1430 Broadway, Suite 2200, New York, NY 10018 ("DISH," "we," or "us"). They govern your access to and use of the DISH mobile application, website, and related services (together, the "Service").
By creating an account, checking any acceptance box, or otherwise using the Service, you agree to be bound by these Terms, by the Community Guidelines in Part Two, and by our Privacy Policy, each of which is incorporated here by reference. If you do not agree, do not use the Service.
1. What DISH is
DISH is a social discovery platform focused on individual dishes rather than restaurants as a whole. Through the Service you can photograph and rate dishes, apply and view tags describing flavor, presentation, and value, browse dish rankings and menus, follow other users and creators, and receive suggestions generated by our dish recognition and recommendation systems.
DISH also expects to provide tools for restaurants to claim and manage their listings and view analytics about how their dishes are performing, and tools for creators to build a following. Features described in these Terms may not all be available at any given time. We may add, change, suspend, or remove features at our discretion.
2. Eligibility and your account
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
To use most features you must create an account. You agree to provide accurate and current information, to keep your sign-in credentials confidential, and to tell us promptly at build@thedishapp.com if you believe your account has been accessed without your permission. You are responsible for activity that occurs under your account.
You may not transfer your account to anyone else, or create an account on behalf of another person without their authorization. We may refuse, suspend, or terminate an account that violates these Terms or the Community Guidelines.
3. Your content
You keep ownership of the photos, videos, ratings, reviews, tags, and other material you submit to the Service ("User Content").
By submitting User Content, you grant DISH a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, publicly display, and distribute that content for the purposes of operating, promoting, and improving the Service. This license lasts for as long as your content is on the Service, and for a reasonable period afterwards to allow for removal from backups, caches, and content delivery networks. It ends when you delete the content or your account, except to the extent the content has been shared with others who have not deleted it, or where we are required to retain it to comply with law.
You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe anyone else's rights.
Content you make public may be viewed, saved, screenshotted, and shared by others. We cannot retrieve it once that has happened.
4. Creator accounts
DISH may offer tools for creators to build an audience, and may in future offer programs involving payment or revenue share. Any such program will be governed by separate terms presented to you before you join it. Nothing in these Terms obliges DISH to offer any creator program or to make any payment.
5. Restaurant accounts
Restaurants and food businesses may be able to claim a listing on DISH and access analytics about how their dishes are performing. A business that claims a listing is responsible for the accuracy of the information it submits, including menu items, prices, hours, and imagery, and represents that it is authorized to act on behalf of that business.
Analytics we provide to restaurants are aggregated and do not identify individual diners.
6. Acceptable use
You agree not to:
- Post content that is false, defamatory, harassing, hateful, obscene, or unlawful
- Impersonate any person or business, or misrepresent your affiliation with one
- Manipulate ratings, reviews, or rankings, including through multiple accounts, paid reviews, or coordinated activity
- Scrape, crawl, or use automated means to access or extract data from the Service
- Reverse engineer, decompile, or attempt to derive the source code of the Service
- Introduce malware or attempt to gain unauthorized access to the Service or to other users' accounts
- Use the Service for any unlawful purpose, or in violation of the Community Guidelines in Part Two
The Community Guidelines form part of these Terms, and violating them violates these Terms.
7. Third-party services
The Service links to and may work alongside reservation platforms, delivery platforms, mapping providers, and other third parties. Those services are operated by others under their own terms and privacy policies. DISH is not a party to any transaction you enter into with them, does not control their content or availability, and is not responsible for their acts or omissions.
8. Our intellectual property
Apart from User Content, the Service and everything in it — including software, design, text, graphics, the DISH name and logo, and our tagging and ranking systems — is owned by DISH or its licensors and protected by intellectual property laws.
We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of it without our written permission.
9. Fees
The Service is currently free for diners. We may introduce paid features, including business subscriptions or premium tools. Any fees, and the terms attaching to them, will be disclosed before you incur them. We may change pricing on notice.
10. Suspension and termination
You may stop using the Service and delete your account at any time from within the app.
We may suspend or terminate your access, with or without notice, if you breach these Terms or the Community Guidelines, if we are required to by law, or if continuing to provide the Service to you would create risk for DISH or for other users.
Sections 3, 6, 8, and 11 through 16 of this Part One survive termination.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
DISH does not warrant that the Service will be uninterrupted or error-free, or that information on the Service — including dish descriptions, menus, prices, hours, allergen and dietary information, ratings, and recommendations — is accurate, complete, or current. Menu and allergen information is supplied by restaurants, third-party data providers, and other users, and may be wrong or out of date.
If you have a food allergy or dietary restriction, do not rely on DISH. Confirm directly with the restaurant before ordering or eating.
12. Limitation of liability
To the fullest extent permitted by law, DISH and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of the Service.
Our total liability for all claims relating to the Service is limited to the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months before the claim arose.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless DISH and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your violation of these Terms or the Community Guidelines, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
15. Copyright complaints
If you believe content on DISH infringes your copyright, send a notice to build@thedishapp.com including:
- Your contact details
- Identification of the work you say is infringed
- Identification of the material you want removed, and where it appears on the Service
- A statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
We will respond to valid notices as required by the Digital Millennium Copyright Act, and may remove content and terminate repeat infringers.
16. General
Entire agreement. These Terms, the Community Guidelines, and the Privacy Policy are the entire agreement between you and DISH regarding the Service.
Changes. We may update these Terms. If a change is material, we will notify you through the Service or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
Severability. If any provision is held unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Relationship. Nothing in these Terms creates a partnership, employment, or agency relationship between you and DISH.
Part Two — Community Guidelines
DISH is a place to discover, share, and celebrate great dishes — not just great restaurants. Whether you're a diner, chef, host, or creator, these guidelines exist to keep DISH useful, trustworthy, and genuinely about the food. They form part of the Terms of Service above.
1. What DISH is for
DISH is built around dishes: photos, reviews, ratings, stories, and recommendations tied to real food experiences. Content should stay relevant to that purpose.
Post about:
- Dishes, restaurants, ingredients, and menus
- Chef stories, behind-the-scenes moments, and technique
- Honest taste takes, reviews, and recommendations
Keep off DISH:
- Politics, current events, and general news commentary
- Memes, general lifestyle content, or anything unrelated to food
- Off-topic personal commentary not tied to a dining or dish experience
DISH may remove content that isn't related to food or dining, even if it doesn't otherwise violate these guidelines.
2. Be real
DISH works because people trust what they see. That means:
- Use your real identity — don't create an account to impersonate another person, restaurant, chef, or brand
- Don't create multiple accounts to manipulate ratings, reviews, or visibility
- Don't buy, sell, or trade reviews, ratings, or followers
- Don't use bots, scripts, or automation to post content or inflate engagement
Creators. DISH welcomes creators of all sizes — you don't need an existing following to sign up as a creator. Misrepresenting your reach, follower count, or credentials to gain creator status is a violation of these guidelines.
3. Restaurant, brand, and professional affiliation
Who this applies to. DISH lets users identify themselves in certain roles — chef, host, restaurant staff, owner, or representative of a food brand — either during onboarding or on their profile. This section governs anyone making that kind of claim.
Disclosure duty. You may only claim a role or affiliation you actually hold. If you are a chef, host, or staff member, that claim must reflect a real, current or past working relationship with the restaurant you name. If you represent a food brand, you must actually be authorized to speak for that brand. Do not:
- Claim to work at, own, or represent a restaurant or business you have no real connection to
- Continue displaying an affiliation after that relationship has ended, without updating it to reflect past rather than current status
- Create or use an account on behalf of a restaurant or brand without that business's knowledge or authorization
How affiliations are confirmed. Most affiliation claims on DISH are self-reported. A chef, host, or brand-representative label on a profile generally reflects a claim made by that user, not confirmation, endorsement, or investigation by DISH. Where a restaurant has an account on DISH, it may confirm that someone works for it — but the absence of that confirmation does not mean a claim is false, and its presence is not a guarantee by DISH.
Reporting a false claim. A restaurant or business that believes someone has falsely claimed affiliation with it may report the profile to build@thedishapp.com with a brief description of why the claim is believed false. DISH may request supporting documentation before removing a claim.
Enforcement. DISH may, at its discretion and without prior notice, remove a false affiliation claim, suspend or terminate the responsible account, and restrict that user's ability to add future affiliation claims. Repeated or willful false claims — for example, impersonating a specific named chef or restaurant — may result in immediate account termination.
Liability. DISH disclaims all liability arising from any user's false, inaccurate, or misleading claim of affiliation with a restaurant, brand, or business. Users agree to indemnify and hold DISH harmless from any claims, losses, or damages arising from their own false or unauthorized affiliation claims.
4. Respect the community
- No harassment, threats, or targeted abuse of other users, chefs, restaurants, or staff
- No hate speech or content that attacks people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- No bullying, pile-ons, or coordinated efforts to harm someone's reputation
- Disagreement about a dish or restaurant is fine; personal attacks are not
5. Privacy
- Don't post identifiable photos or videos of other diners or staff without their consent
- Don't share another person's private information, such as phone numbers, addresses, or payment details
- Restaurant staff appearing incidentally in a dish photo or video — a chef plating in the background, for example — is generally fine; content specifically targeting an individual staff member without consent is not
- If you save dietary or allergy information about someone you dine with, only do so with their permission
6. Intellectual property
- Only post photos, videos, and content you created or have the right to share
- Don't copy another user's or restaurant's content and repost it as your own
- Restaurants retain rights to their own branding, menus, and imagery; DISH does not grant users rights to reuse restaurant-owned content outside the app
7. Safety and minors
- DISH is not intended for users under 13, or the minimum age required by local law where that is higher
- Do not post content that endangers, sexualizes, or exploits minors
- Do not use DISH to arrange in-person meetings that could put another user at risk
8. No spam or unauthorized promotion
- Don't use DISH to post unrelated advertisements, referral links, or repeated self-promotion
- Restaurants and brands should use official business tools, once available, rather than posing as ordinary diners to promote themselves
- Don't incentivize reviews — for example, offering a discount in exchange for a positive rating — outside of any official DISH program
9. Reporting and enforcement
You can report content or profiles that violate these guidelines by emailing build@thedishapp.com. DISH reviews reports and may take action including:
- Removing the violating content
- Issuing a warning to the user
- Temporarily restricting account features
- Suspending or permanently terminating an account
DISH reserves the right to take enforcement action at its discretion, and enforcement may vary based on the severity of the violation, the intent behind it, and the account's history. If you believe an enforcement decision was made in error, you can appeal by emailing build@thedishapp.com.
10. Changes to these guidelines
DISH may update these Community Guidelines from time to time. Material changes will be communicated through the app or by email where required by law.
